Terms of Use
Effective August 2026
These Terms of Use (the "Terms") are a binding agreement between you and Fan Arch ("Fan Arch," "we," "us," or "our") governing your access to and use of fan-arch-games.vercel.app and our related daily sports games (the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
Please read Section 12 carefully. It requires disputes to be resolved by binding individual arbitration and waives your right to participate in a class action.
1. Eligibility
The Services are intended for users in the United States who are at least 13 years old. If you are under 18, you may use the Services only with the involvement of a parent or guardian. Some content related to sports wagering or prediction-market sponsors is intended only for individuals who meet the legal age for sports wagering in their jurisdiction (generally 18 or 21) — see Section 8.
2. The Games
The Services are free games offered for entertainment. No purchase is necessary, nothing is for sale, and game results, streaks, and scores are for fun only — they have no monetary value and cannot be redeemed for money or prizes. We may add, change, suspend, or discontinue any part of the Services, including games and teams, at any time without notice.
3. Not Gambling
The Services are free games of skill and knowledge. They do not involve real-money wagering, betting, or any opportunity to win money or anything of value, and no consideration is required to play. Any sportsbook, prediction-market, or similar content that may appear is provided by third-party sponsors, is separate from the Services, and is governed by those third parties' own terms and age requirements. We are not a gambling operator and do not accept or place bets.
4. Accounts
You do not need an account to play. If you create one (including by signing in with Google), you are responsible for the activity under it and for keeping your sign-in secure. You agree to provide accurate information and not to impersonate anyone. We may suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to:
- scrape, crawl, harvest, or use automated means to access or collect data from the Services;
- copy, reverse engineer, decompile, or attempt to extract the source code or underlying data of the Services, except where such restriction is prohibited by law;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Services or their systems;
- use the Services to violate any law or the rights of others, or for any commercial purpose without our written permission.
6. Intellectual Property
The Services, including their software, design, text, graphics, and the selection and arrangement of content, are owned by Fan Arch or its licensors and are protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial enjoyment. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.
7. No Affiliation; Trademarks; Player Information
Fan Arch Games is an unofficial product. We are not affiliated with, endorsed by, sponsored by, or associated with the NFL, NBA, MLB, NHL, any of their member teams, any players' association, or any athlete, team, league, or organization. All team names, logos, and marks are the property of their respective owners and are used, where they appear, only for identification and descriptive purposes (nominative fair use). Player names and statistics are factual information drawn from publicly available records and are used for identification and commentary; we do not claim any endorsement by, or affiliation with, any named individual.
8. Third-Party Links, Sponsors, and Wagering Content
The Services may include links to, or content from, third parties, including sponsors and affiliate offers such as sportsbook or prediction-market promotions. We are not responsible for third-party content, products, or practices, and your dealings with any third party are solely between you and that party under its own terms. Wagering-related content is intended only for individuals of legal wagering age in their jurisdiction. If sports betting is a concern for you or someone you know, help is available through the National Council on Problem Gambling at 1-800-GAMBLER.
9. Player Data and Accuracy
Statistics and player facts come from public sports records and are provided on an "as is" basis. We aim for accuracy but do not warrant that game content is complete, current, or error-free, and it should not be relied upon for any betting, financial, or other decision.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, FAN ARCH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). BECAUSE THE SERVICES ARE FREE, THIS REFLECTS THE ALLOCATION OF RISK BETWEEN US.
12. Dispute Resolution; Arbitration; Class-Action Waiver
Please read this section carefully — it affects your legal rights. You and Fan Arch agree that any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, rather than in court, except that either party may bring an individual claim in small-claims court. You and Fan Arch waive any right to a jury trial and to participate in a class, collective, or representative action. Arbitration will be conducted by a recognized arbitration provider under its consumer rules.
30-day opt-out. You may opt out of this arbitration agreement by emailing jason@fanarch.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.
These Terms and any dispute are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, and, to the extent a matter proceeds in court, you agree to the exclusive jurisdiction of the state and federal courts located there.
13. Indemnification
You agree to indemnify and hold harmless Fan Arch and its affiliates from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
14. Termination
You may stop using the Services at any time. We may suspend or terminate your access at any time, with or without notice, including for any violation of these Terms. Sections that by their nature should survive termination (including Sections 6, 7, and 10–13) will survive.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the revised Terms with a new effective date. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.
16. Miscellaneous
If any provision of these Terms is found unenforceable, the rest will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and Fan Arch regarding the Services.
