Fan Arch Games Privacy Policy
Version 1.0 — Effective August 2026
Your privacy is important to us at Fan Arch ("Fan Arch," "we," "us," or "our"), and we are committed to safeguarding, preserving, and respecting your privacy rights. This Privacy Policy (the "Policy") describes how we collect, use, disclose, and secure the personal information we gather through fan-arch-games.vercel.app and related daily sports games (the "Services"), and when you otherwise interact with us. By accessing, browsing, or using the Services, you confirm that you have read, understood, and agreed to this Policy. If you do not agree, you may not use the Services.
For purposes of this Policy, "personal information" means data that qualifies as personal information, personal data, or personally identifiable information under applicable privacy laws. It does not include aggregated, anonymized, or de-identified data. Nothing in this Policy constitutes an admission that any particular privacy law applies to Fan Arch in any specific context.
Notice at Collection. At or before the time we collect it, California residents have a right to notice of our practices, including the categories of personal information collected, the purposes for collection, whether it is sold or shared and how to opt out, and how long we retain it. That information is set out throughout this Policy and summarized in "Additional California Disclosures" below.
If you have questions about this Policy, contact us using the information in "Contact Us" below.
Categories of Personal Information We Collect
The following categories describe the personal information we collect and the purposes for which we collect it.
Account Information includes your email address, name, and profile photo if you sign in with Google, and a display name and optional profile picture if you create one. We collect this information for account creation and maintenance, providing the Services, personalization, and customer service.
Activity Information includes the puzzles you've played, your results, your streaks, how often and recently you play, and your pick accuracy across teams and leagues. We collect this information to operate the Services, personalize the content and offers we send you, and for analytics and research.
Location Information includes your approximate location — country and state or region — estimated from your internet connection. We do not collect or store precise GPS location. We collect this information to route relevant sponsor content and to comply with applicable state advertising requirements, such as those relating to sports wagering content described below.
Interest Information includes your response to the optional question of whether you follow betting lines or odds. Answering is entirely voluntary. We collect this information, where provided, to personalize the content and offers we send you.
Referral Information includes which Fan Arch show, link, or campaign referred you to the Services, such as a campaign tag included in a URL. We collect this information to credit the correct show and to measure which content is effective.
Analytics Information includes information collected automatically as you use the Services, such as your browser and device type, the pages you visit, the date and time of your visit, and information collected through cookies, pixels, and similar technologies (see "Cookies and Other Tracking Technologies" below). We collect this information for analytics and research, advertising and marketing, and website security and maintenance.
If you use the Services without signing in, your progress, streaks, favorites, and profile remain in your browser and are not sent to us. When you sign in, this information syncs to your account so it follows you across devices.
How We Use Information
We use the categories of personal information described above for the following purposes:
- Providing the Services — operating and maintaining the Services, syncing your profile, favorites, and streaks across devices, and improving how the Services function.
- Personalization — tailoring the puzzles, content, and sponsor offers we show or send you based on your team, region, activity, and interests.
- Communications — sending you the daily game reminder and Fan Arch news or offers, where you've opted in.
- Analytics and Research — understanding which shows, links, and campaigns are effective, and how players engage with the Services, including through aggregated and de-identified reporting.
- Advertising and Marketing — informing sponsor and advertising campaigns, including through aggregated or segment-level insights.
- Legal and Security Purposes — complying with applicable law, enforcing our Terms of Use, and protecting the security of the Services.
How We Share Information
We may share your information in the following circumstances:
Service Providers. We use vendors — including hosting and storage, email delivery, and analytics providers — to operate the Services. These vendors process information on our behalf under contract and are not permitted to use it for their own independent purposes.
Sponsors and Advertising Partners. We may share aggregated or de-identified insights with sponsors and advertising partners to inform their campaigns and help them reach relevant audiences. We do not disclose your individual identity to sponsors or advertisers as part of this sharing.
Affiliate and Referral Partners. If you follow a link to a sponsor or affiliate offer — for example, a sportsbook or prediction market promotion — you will leave the Services, and any information you provide directly to that company is governed by its own privacy policy, not this one. That partner may report back to us whether a referral converted into a signup, which we use to measure content performance; this does not involve us transmitting your personal information to that partner.
Analytics and Advertising Technology Providers. We and our partners use tools such as web analytics and advertising pixels to understand engagement with the Services and to help us and our partners deliver more relevant advertising on and off the Services.
Business Partners. We may share information with business partners such as marketing partners and co-branded partners in connection with operating and promoting the Services. Any information shared in this way remains subject to this Policy.
Affiliates. We may share information with our affiliates, subsidiaries, or other companies under common control with Fan Arch.
Business Transactions. We may share personal information with a third party as part of any potential business or asset sale, merger, acquisition, investment, or similar transaction. If we are entering into such a transaction, we may also receive personal information from a counterparty in connection with due diligence. If a transaction closes, personal information may transfer to the acquiring party, who would use it as described in this Policy or a successor policy.
Legal Purposes. We may disclose information to comply with applicable law, respond to legal process, establish or defend our legal rights, or protect the rights, property, or safety of Fan Arch, our users, or others.
Cookies and Other Tracking Technologies
We and our service providers may use cookies and similar technologies — including pixels, tags, and other tools — when you use the Services. These technologies can collect information about your browser or device, IP address, general geographic location, the pages you visit, and how you interact with the Services and our emails.
What cookies do we use, and why?
- Essential cookies are required for the Services to function and let you navigate and use core features. Disabling these can negatively affect how the Services work.
- Functional cookies recognize you when you return to the Services, allowing us to remember your preferences and support features like customer support.
- Analytics and performance cookies help us understand how players use the Services — for example, recognizing and counting visitors and seeing how they move through the Services — so we can improve functionality and measure the effectiveness of our content and campaigns.
- Advertising and social cookies are used to deliver more relevant advertising, track campaign performance, and let you share content on third-party platforms.
Session cookies expire when you close your browser. Persistent cookies remain on your device between sessions until they expire or are deleted, and are used for purposes such as remembering your preferences and measuring engagement over time.
Managing cookies. You can block or delete cookies through your browser settings. If you block essential cookies, some parts of the Services may not work correctly.
Do Not Track. Where a browser sends a Do Not Track signal, we respond by limiting non-essential cookies to essential ones only.
Your Privacy Rights
Depending on your state of residence, you may have the following rights with respect to your personal information:
- Right to Know/Access — to confirm whether we are processing your personal information, to know the categories and specific pieces of personal information we've collected, and to obtain a list of third parties or categories of third parties to whom we've disclosed it.
- Right of Correction — to correct inaccuracies in your personal information.
- Right of Deletion — to delete your personal information, subject to certain exceptions.
- Right of Portability — to obtain your personal information in a portable, readily usable format.
- Right to Opt Out — to opt out of the sale or sharing of your personal information, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects.
- Right to Non-Discrimination — we will not deny you goods or services, charge you different prices, or provide a different level or quality of the Services because you exercised any privacy right described in this Policy.
Sensitive information. Where we process information that qualifies as "sensitive" under applicable law, we do so only for purposes permitted by that law, and in a manner that is reasonably necessary and proportionate to those purposes.
Exercising your rights. To exercise any right described above, email jason@fanarch.com or use the link below.
Do Not Sell or Share My Personal Information
We recognize the Global Privacy Control as a valid opt-out preference signal.
Verification. We may request information reasonably necessary to verify your identity before fulfilling a request, such as confirming details associated with your account. If you're an authorized agent submitting a request on someone else's behalf, we may require signed written authorization or a power of attorney, and may still independently verify the underlying account holder's identity.
Response time. We will respond to access, correction, deletion, and portability requests within 45 days of receipt. If we need more time, we will notify you of the delay and the reason for it.
Appeals. If we deny or decline to act on a request, you may appeal by resubmitting it. We will respond to appeals in writing within 45 days, including our reasoning.
Additional California Disclosures
In the preceding 12 months, we have collected the categories of personal information described in "Categories of Personal Information We Collect" above, which include identifiers, internet or similar network activity, geolocation data, and inferences, as those terms are used under the California Consumer Privacy Act.
In the preceding 12 months, we have disclosed identifiers, internet or similar network activity, and geolocation data to service providers for our business purposes, as described in "How We Share Information."
In the preceding 12 months, we have shared identifiers and internet or similar network activity for cross-context behavioral advertising through the cookies and advertising technologies described above. We have not sold personal information for monetary consideration; however, our use of advertising cookies and similar technologies may be considered a "sale" or "share" of personal information under the CCPA, which is why the opt-out described above is available to you.
We have not knowingly collected or processed personal information belonging to children under 13.
Data Retention
We retain personal information for as long as your account is active or as needed to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer necessary for these purposes, we delete it or de-identify it, subject to any exceptions required or permitted by law.
Data Security
We use commercially reasonable administrative, technical, and physical measures to protect personal information from unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee the absolute security of information you provide to us.
Where Your Information Is Held
We process personal information on servers located in the United States. If you access the Services from outside the United States, you consent to the transfer, processing, and storage of your information in the United States.
Sports Wagering Content
Some content, offers, or communications on the Services relate to sports wagering or prediction market sponsors and are intended only for individuals who meet the applicable legal age for sports wagering in their jurisdiction. By engaging with this content, you represent that you meet that requirement. We do not use Interest Information to target individuals who indicate they do not meet the applicable age requirement, or individuals on a sportsbook or gaming operator's self-exclusion list. If you believe you've received this content in error, contact us immediately using the information below.
Resources for problem gambling are available through the National Council on Problem Gambling at 1-800-GAMBLER.
Third-Party Links
The Services may contain links to third-party websites, including sponsor and affiliate offers. We provide these links as a convenience and are not responsible for the content, privacy practices, or security of any third-party site. This Policy applies only to the Services; we encourage you to review the privacy policy of any third-party site you visit.
Children's Privacy
The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information from a child under 13, we will delete it, unless we are required to retain it for legal or compliance purposes. If you believe we may have information from a child under 13, contact us using the information below.
Changes to This Policy
We may update this Policy from time to time. If we do, we will post the revised Policy with a new effective date, and, for material changes, provide additional notice as required by law. Your continued use of the Services after a change takes effect constitutes acceptance of the revised Policy.
